A woman filing criminal complaints against her husband and in-laws would not amount to cruelty, says the Madras High Court.

According to recent developments, a bench of Justice R Suresh Kumar and K Kumaresh Babu said that it is not cruelty when a wife files a criminal complaint against her husband and in-laws. The bench said that in this case, the criminal complaints filed by the wife resulted in calendar cases on the chargesheet after proper investigation by the police concerned.

It further noted that the wife did not dispute the filing of the criminal cases against her husband and in-laws.

The statement from the Madras High Court has come after the facts of the case, the marriage between the parties took place on August 21, 2008, as per Hindu rights and customs. However, the relationship turned sour after various disputes between them. The husband accused his wife of mentally torturing and harassing him and insisted him to leave his family, even threatened her that she would die by suicide.

On the other hand, the wife claimed that her husband tortured her mentally and physically, due to which she filed several complaints with the local police in Chennai.

Amidst the disputes, the husband abandoned the wife and refused to return to her despite her plea for restoration of conjugal rights. This was in response to the husband's petition for the dissolution of their marriage.
