In a recent legal development, the Allahabad High Court recently dismissed a protection plea filed by a woman in a live-in-relationship, who was married off by her father at the age of 13 to another man. The High Court has said that boys and girls from different religion cannot get in a live-in relationship without religious conversion.
The court noted that despite reaching the age of majority, the woman had not applied for the dissolution of her marriage or sought divorce from the appropriate court, rather, she started a live-in-relationship.
A bench of Justice Renu Agarwal stressed that endorsing such relationships would disrupt societal norms. In this case the boy is from Hindu community while the girl is from Muslim community. Both are originally residents of Kasganj, UP.
According to the information, a woman had filed a petition in Allahabad High Court demanding security, which has been rejected outright by a bench of Justice Renu Aggarwal. The High Court said in its order that without divorce, a married woman cannot live in a live-in relationship, recognizing such relationships will increase anarchy.
The court has said that relationships against the law cannot get the support of the court. Under the Hindu Marriage Act, if the husband and wife are alive and if they are not divorced, then they cannot marry again. The court said, if the relations of already married people are supported by the court, there will be anarchy in the society and the social fabric of the country will be destroyed.
With this, Justice Renu Aggarwal has rejected the petition filed by Kasganj's Pooja Kumari and others demanding protection of live-in relationship, imposing a compensation of Rs 2,000.
