The Delhi government on Friday moved the Supreme Court against the centre’s ordinance. The petition claims that the Ordinance is illegal because it transfers power from an elected government to an unelected LG while failing to modify Article 239AA of the Constitution.

The authority for the transfer and posting of IAS and DANICS personnel in the national capital was granted by an ordinance that the Centre had enforced on May 19. The decision was referred to as a circumvention of the Supreme Court’s ruling on the control of services by the Arvind Kejriwal administration.

The law was released a week after the Supreme Court gave the elected government jurisdiction over all services in the capital, with the exception of police, public order, and land.

Before the decision by Supreme Court was issued on May 11, the LG exercised executive authority over all officer transfers and postings within the Delhi government.

Meanwhile, Arvind Kejriwal, the chief minister of Delhi, had been gaining support from the opposition parties against the decree from the centre. In fact, on July 3, he’ll also burn copies of the ordinance at the party headquarters in Delhi.
