As per sources, the Jharkhand high court reserved the order in a defamation case against Rahul Gandhi on Tuesday. The arguments were concluded in the court of Justice Ambujnath, where both sides are instructed to file a synopsis of the arguments.

Notably, the defamation case was filed by a local Bhartiya Janata Party (BJP) leader after Congress leader Rahul Gandhi made objectionable remarks against Union Minister Amit Shah at a party gathering in Chaibasa in 2018. “A murder accused can become a party president in BJP only. It is not possible in Congress,” Rahul Gandhi allegedly made the remarks.

According to the information, the notice was issued by the lower court to Rahul Gandhi in the case. Whereas, the same was challenged n the High Court to quash the notice issued by the lower court. The case was represented by Advocate Piyush Chitresh and Advocate Dipankar Rai on behalf of Rahul Gandhi. Notably, the ‘no coercive action’ was ordered by the court on May 12.

Another defamation Case against Rahul Gandhi

It should be noted that Rahul Gandhi received a two-year prison term in Surat, Gujarat after being found guilty of criminal defamation in a case involving his comments about the “Modi surname” in 2019. This was said by him while addressing a crowded rally in Kolar, Karnataka, before the 2019 Lok Sabha elections.

Notably, BJP MLA and former Gujarat minister Purnesh Modi filed a complaint against his comments. Gandhi was accused of saying, “How come all the thieves have Modi as the common surname?” A complaint was then brought against him. Purnesh Modi, an MLA for the Bharatiya Janata Party (BJP), filed the lawsuit following sections 499 and 500 (defamation) of the Indian Penal Code.

Following this, Rahul Gandhi was disqualified as a member of the Lok Sabha in March. And he will be disqualified from serving as a member of parliament and will be prohibited from running for office for eight years if he is unable to have his conviction overturned. He has already left the bungalow he was given by the government.
