CM Kejriwal's PS (Personal Secretary) Bibhav Kumar has been sent to police remand in connection with the alleged assault and misbehavior with Aam Aadmi Party (AAP) MP Swati Maliwal. Delhi Police presented Bibhav Kumar in the court of Metropolitan Magistrate Gaurav Goyal of Tis Hazari Court on Saturday (May 18). Delhi Police asked for 7 days police remand of Bibhav Kumar. The court sent him on remand for 5 days. Kumar was arrested from Kejriwal's residence at Flagstaff Road in north Delhi's Civil Lines earlier on Saturday while his anticipatory bail petition was subsequently observed as becoming "infructuous" by the court.

What has lawyer said?
Bibhav Kumar's lawyer Rajiv Mohan said that even if the format of the mobile is correct, it has nothing to do with this case. Nowhere in the complaint was it said that Bibhav used to call or threaten through WhatsApp or calls. As far as password is concerned, Apple never gives the password of its user's mobile. This arrest itself is not justified. There is no question of police custody. The only purpose of the arrest was to get the anticipatory bail petition rejected. The arrest was made in haste. Even a copy of the FIR was not given, although it is all over the media.
He said that Swati Maliwal had reached the Chief Minister's residence without prior appointment. She had reached there of her own free will. Now she should also tell when before this she had gone to meet the CM without an appointment? What was his purpose of going to CM residence? The video of Swati coming out of the Chief Minister's residence is circulating in the media. He is wearing a kurti and not a shirt. Therefore, the talk about buttons opening or breaking is also not correct.
Advocate Rajeev Mohan said in the court that the matter of hitting Swati Maliwal's head on the central table is also not correct. There is no visible injury on her head. Delhi Police is distorting the facts. What was the hindrance behind not registering the FIR for three days? Why did you not get the medical examination done on the same day? If there was so much injury then why did you not go for first aid on the same day? Delhi Police responds immediately to the call of 112. Why was an FIR not immediately lodged based on what was told to the police on the call? Not only this, medical help was also not sought.
According to the FIR lodged by Swati Maliwal, she had reached CM Arvind Kejriwal's house early in the morning to meet him. She first went to the CM's camp office. After this he called CM's PS Bibhav Kumar, but the conversation did not take place. Swati Maliwal also sent a WhatsApp message to Vibhav's mobile number, but did not receive any reply. After this, as usual, she went to CM Kejriwal's house through the main door. There she was asked to sit in the drawing room and was told that the Chief Minister was present in the house and he would come to meet him soon. But before the CM could come to him, his PS Vibhav Kumar stormed into the room and without any provocation started abusing him. They even attacked him without any provocation and started beating him. According to Swati Maliwal, first he slapped her 7-8 times continuously, due to which she became very frightened and started screaming for help. She somehow tried to push Vibhav away from herself with her feet. After this Bibhav Kumar again pounced on him and started dragging him. She deliberately lifted his shirt up, due to which the buttons of the shirt opened. In this fight, Swati fell on the ground and her head hit the center table kept in the drawing room. She was screaming for help, but there was no one there to help her.
Three days later, Swati Maliwal gave his statement to Delhi Police and then the police registered an FIR against Bibhav in this case. At present, in this FIR, the police have registered IPC sections 308 (attempt to commit culpable homicide), 323 (assault), 341 (wrongful restraint), 354 (assault with intent to outrage her modesty), 354B (disrobing a woman) against Vibhav Kumar. Attempt), 506 (criminal intimidation) and 509 (attempt to outrage the modesty of a woman) have been imposed. According to Supreme Court lawyer Anurag Kishore, these crimes are serious. If the crime is proven in this case then it is certain that there will be severe punishment.
