West Bengal approves Aparajita bill: All you need to know about anti-rape law

New Delhi: The West Bengal Assembly has unanimously approved the 'Aparajita' bill, marking a historic advancement in the fight against rape and sexual offenses. This groundbreaking legislation positions West Bengal as the first state to amend central laws specifically targeting such heinous crimes, following the tragic rape and murder of a trainee doctor at RG Kar Medical Centre and Hospital last month.

Mamata Banerjee's historic initiative

Chief Minister Mamata Banerjee has described the 'Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) 2024' as “historic” and “model.” She dedicated the bill to the memory of the 31-year-old victim, emphasizing its role in strengthening the legal framework against gender-based violence. The bill introduces the death penalty for those convicted of rape and severe sexual crimes, representing a significant shift in the state's approach to tackling such offenses. 

Banerjee stated, “From here, after passing this bill, it will go to the Governor; after his approval, it will be sent to the President and upon her approval, it will become historic.”

Key pointers of the 'Aparajita' bill

The Aparajita Bill includes several robust measures aimed at closing existing gaps in central legislation:

  • Harsh penalties for sexual crimes: The bill mandates the severest penalties for cases involving harassment and rape of women.  
  • Strengthened POCSO act provisions: Enhancements to the Protection of Children from Sexual Offenses (POCSO) Act are included, providing tighter regulations to protect minors. 
  • Death penalty for severe cases: The legislation stipulates the death penalty for rapists if their crimes result in the death of the victim or cause severe brain damage.
  • Formation of the Aparajita task force: A dedicated task force will be established to ensure that justice is delivered within 21 days of receiving a preliminary report.
  • Enhanced security measures: Routes frequently used by nurses and female doctors will be covered under new security measures, with the state government allocating Rs 120 crores for this purpose.
  • Installation of CCTV cameras: Comprehensive surveillance will be implemented through widespread installation of CCTV cameras.  
  • Ratri Saathi provision: This provision ensures that women working night shifts will receive full security, with doctors extending their duties as needed.
