The Waqf Act's future hangs in balance: 10 petitions filed in Supreme Court challenge legitimacy

Delhi:  The voice raised against the Waqf Act in the Parliament has now reached the Supreme Court of the country. The number of petitions challenging the Waqf Act 1995 is constantly increasing in the Supreme Court. So far, about 10 petitions have been filed. In these, the Waqf Act has been described as unconstitutional and causing religious discrimination. The Chief Justice has taken this matter seriously.

Delhi:  Both the politics and the court of the country are heated up regarding the Waqf Amendment Act 2025. So far 10 petitions have been filed in the Supreme Court against this law. The petitioners claim that this law is an attack on the religious freedom and constitutional rights of Muslims. In all the petitions, the court has been asked to declare this law unconstitutional. In this case, Congress MP Mohammad Javed, AIMIM chief Asaduddin Owaisi, Aam Aadmi Party MLA Amanatullah Khan, Jamiat Ulema-e-Hind, Indian Muslim League, Samastha Kerala Jamiathul Ulema, APCR, SDPI, Tayyab Khan Salmani and Anjum Qadri have knocked the door of the Supreme Court.

The matter was placed before the CJI's bench

The matter was mentioned before the bench of Chief Justice Sanjeev Khanna on behalf of the Indian Union Muslim League. The court assured that the matter will be considered in the afternoon and it will be decided when the hearing can take place.

What is the objection of the petitioners?

The petitioners have argued that this law violates Articles 14, 15, 21, 25, 26, 29, 30 and 300-A of the Constitution. They say that this is a law that only affects the property and religious freedom of Muslims. AIMIM leader Asaduddin Owaisi has described this law as against the fundamental rights of Muslims. He registered his protest by tearing a copy of the bill in the Lok Sabha. At the same time, Congress MP Mohammad Javed called it a law discriminating against the Muslim community.

How was the law made?

In the Lok Sabha, 288 votes were cast in favour of the Wakf Amendment Bill while 232 were against it. In the Rajya Sabha, 132 votes were in favour of the bill and 95 against it. After being passed by both the houses, this bill became a law as soon as it got the President's approval.

Unity of opposition parties

Many parties including Congress, AIMIM, AAP, RJD, DMK are seen united against the Waqf Amendment Act. These parties say that this law is not only an attack on the religious freedom of the Muslim community but is also against the basic spirit of the Constitution.

 Keep an eye on the Supreme Court's decision

Now the eyes of the whole country are on the Supreme Court. Everyone wants to know what decision the court will give in this case. This law has been challenged constitutionally, the hearing of which is considered very important. The comments and decisions of the court can have a big impact in the coming days. It remains to be seen whether the Supreme Court justifies this law or orders any change or ban in it. Now the future picture will depend on the court hearing and its decision.
