Unnao Rape Case: The Delhi High Court has recently provided anticipatory bail to the victim of the Unnao gang rape case and her mother concerning a forgery case, which was transferred to Delhi by the Supreme Court.

Alleged Forgery of Date of Birth

The case revolves around the alleged forgery of the victim's date of birth, resulting in an FIR filed under sections IPC 419/420/467/468/471 at Makhi police station, Uttar Pradesh. The complaint was lodged by Haripal Singh, the husband of a woman previously accused and acquitted in a gang rape case.

Previous Protection by Delhi HC

Previously, the Delhi High Court had granted protection, restraining coercive action against the victim in connection to this case.

Expelled BJP MLA Conviction

Kuldeep Singh Sengar, the expelled BJP MLA, has already been convicted under the POCSO Act for the rape of a minor victim. He is serving a life sentence, with his appeal pending before the Delhi High Court.

Anticipatory Bail Granted

Justice Sudhir Kumar Jain granted anticipatory bail to the victim and her mother. The decision came after the Additional Public Prosecutor assured that the charge sheet had been filed, and the petitioners wouldn't be arrested until further court order.

Release on Bail Conditions

"In case of arrest either by the trial court or by an investigating agency, the petitioners shall be released on bail on furnishing a personal bond for Rs 20,000 with one local surety of the like amount," directed Justice Jain on November 17.

Legal Representation

Advocates RHA Sikander and Jatin Bhatt represented the accused persons during the proceedings.

Case Background and Transfer

The petitioner, the victim in the FIR related to the Unnao gang-rape case, sought anticipatory bail. The trial's jurisdiction has been transferred to the Court of the Sessions Judge, South-East District, District Courts Complex, Saket, New Delhi, as per the Supreme Court's order of September 2, 2022.

Forward Steps and Court's Caution

The High Court's order stated that no precipitate action affecting the petitioner's liberty shall be taken by the trial court, subject to the petitioner's appearance when required. The trial court, located in Saket, New Delhi, would oversee further developments in the case.
