Tolerance, adjustment and respect are the foundation of a sound marriage. Small disputes should not be exaggerated. Tolerating each other's mistakes to a certain extent should be inherent in every marriage. Many times, parents and close relatives of a married woman create a ruckus. Instead of saving the marriage, they take such steps that on small issues they completely destroy the marital bond, the Supreme Court said on Friday while quashing a dowry-harrasment case filed by a woman against her husband.
Actually, a woman had filed a case of dowry harassment against her husband. The case reached the court. During the hearing, the Supreme Court has said that there is a need for changes in Sections 85 and 86 of the Indian Judicial Code which will come into effect from July 1. The FIR said the woman's family had spent a large sum at the time of her wedding and also handed over her "streedhan" to the husband and his family. However, her in-laws started pressurizing her for more dowry.
The bench of Justices Jamshed Pardiwala and Manoj Mishra said that Section 85 of the Indian Judicial Code is a version of the existing IPC Section 498A. The definition of cruelty has been expanded in Section 86. The Supreme Court had ordered reconsideration of dowry prevention laws 14 years ago. Cases of harassment of married women for dowry are greatly exaggerated.
The court said that the Supreme Court has given many decisions on its misuse. Have told the government that there is a need for reconsideration. But, the decisions of the Supreme Court have not been given place in the new law. The Supreme Court said this in the case of harassing a married woman for dowry. The court has sent a copy of its decision to the Home and Law Ministry. So that changes can be made in the Indian Judicial Code replacing the IPC.
The court said that the foundation of a good marriage is tolerance, adjustment and respecting each other. Small squabbles and minor differences are worldly matters and should not be blown out of proportion. Matches are made in heaven. It is not appropriate to destroy it in any way.
The bench said that the first thing that comes to the mind of the woman, her parents and relatives is the police, because it appears that the police is the panacea for all evils. Even if there is a reasonable possibility of reconciliation between husband and wife, the matter is brought to an end by taking it to the police. The main victims in these disputes are children.
The court said, 'The husband and wife fight with so much hate in their hearts that they do not think even for a moment that if the marriage ends, what will be the effect on the children. As far as the upbringing of children is concerned, divorce plays a very dubious role. The only reason why we are saying this is that instead of handling the entire matter with a cool head, initiating criminal proceedings will lead to nothing but hatred for each other.
