Supreme Court is set deliver its verdict on DelhI Chief Minister Arvind Kejriwal's petition against his arrest by the Enforcement Directorate (ED) in connection with the money laundering case linked to the now-scrapped Delhi excise policy on Friday.
The Supreme Court's two-judge bench, comprising Justices Sanjiv Khanna and Dipankar Datta, has reserved its verdict on the bail plea of Delhi Chief Minister Arvind Kejriwal, following extensive hearings that delved into critical aspects of the case.
The apex court, during the proceedings, directed the Enforcement Directorate (ED) to furnish specific documents, including witness statements recorded subsequent to the arrests of key figures involved in the case. The bench emphasized, "We want to examine the statements of witnesses post-Manish Sisodia's arrest, post the denial of bail to him, and before Kejriwal's own arrest."
Additional Solicitor General S V Raju informed the court about new evidence uncovered during the investigation, highlighting the discovery of hawala transactions and incriminating WhatsApp communications. In response to queries from the bench regarding the disclosure of grounds for arrest, Raju asserted, "The probe agency is not obligated to disclose every detail to the accused." The bench countered, asking how the accused could challenge the grounds for arrest if they were not provided.
Meanwhile, the ED has filed a chargesheet in the Delhi liquor policy case, implicating Arvind Kejriwal in an alleged Rs 100 crore kickback scandal linked to the formulation of a favorable liquor policy. According to the chargesheet, AAP leader Kejriwal collaborated with individuals associated with the 'South Group', including Vijay Nair, to secure undue benefits for private entities through the policy.
In his defense, Chief Minister Kejriwal clarified to the ED that Vijay Nair was under the supervision of Delhi Ministers Atishi and Saurabh Bhardwaj, not directly under him. Arvind Kejriwal was arrested by the ED on March 21 in connection with a purported conspiracy involving AAP leaders to manipulate the liquor policy for the benefit of liquor vendors. The Supreme Court's impending verdict on Kejriwal's bail plea is awaited amidst these developments, marking a critical juncture in the legal battle surrounding the Delhi Chief Minister.
