New Delhi: In a significant turn of events, Maharashtra Assembly Speaker Rahul Narwekar pronounced the verdict on the Sena versus Sena case, stating that the leadership structure of the Shiv Sena in 2018 did not align with the constitution of the undivided party. The ruling highlighted that Uddhav Thackeray lacked the authority to remove Eknath Shinde from the position of the legislature party leader, as per the Shiv Sena constitution.

Constitutional adherence, leadership structure

Speaker Narwekar, while delivering the lengthy verdict, emphasised the relevance of the party's constitution in determining the leadership structure. The intricacies of the leadership structure, in turn, played a pivotal role in identifying the legitimate faction of the Shiv Sena.

Uddhav faction's response, Supreme Court approach

Anticipating the verdict, the Uddhav faction had already approached the Supreme Court, expressing concerns about a pre-determined outcome. Former minister and Maharashtra MLA Aaditya Thackeray raised objections, stating, "The Speaker meeting the Chief Minister ahead of the verdict gives the impression that the one who had to impart justice went to the accused. It has never happened in history."

Timeline of the Sena leadership power struggle

The power struggle within the Shiv Sena unfolded in 2022 when Eknath Shinde, backed by approximately 50 MLAs, declared a rebellion against then-Chief Minister Uddhav Thackeray.

  • June 2022: Shinde's rebellion led to a political crisis, with his supporters staking a claim to the government with BJP's support.

  • June 29, 2022: The Supreme Court approved a floor test in the Assembly, leading to Uddhav Thackeray's resignation as the Chief Minister.

  • June 30, 2022: Eknath Shinde assumed the role of Chief Minister after winning the floor test in the assembly.

  • October 2022: The Election Commission froze the Shiv Sena's bow and arrow symbol.

  • February 2023: The Election Commission granted the bow and arrow symbol to the Shinde faction.

  • May 2023: A five-judge Constitution bench decided not to disqualify the Eknath Shinde-led Maharashtra government, citing Uddhav's resignation before the floor test.

  • December 15, 2023: The Supreme Court granted an extension until January 10 for the Speaker to deliver a verdict on disqualification petitions against MLAs, including Shinde.

Impact on Shiv Sena's political landscape

The recent verdict adds another chapter to the ongoing political saga within the Shiv Sena. The implications of this ruling will undoubtedly shape the future dynamics of the party and the broader political landscape in Maharashtra.
