The Supreme Court rejected the plea of Union Minister Jyotiraditya Madhavrao Scindia challenging the election to the Rajya Sabha on Friday.
A bench comprising of Justice Sanjay Karol and Justice Hrishikesh Roy dismissed the Special Leave Petition filed challenging the election to Rajya Sabha by Union Minister for Civil Aviation and Steel Jyotiraditya M Scindia.
The Special Leave Petition challenged the framing of a pimary issue in the election petition filed against Scindia to the effect of whether just registration of an FIR constitutes a “pending criminal case” liable to be disclosed in the nomination of papers of a prospective candidate under the Representation of People’s Act, 1951.
The dismissal of the review petition was filed challenging the order in which the said preliminary issue was framed.
While dismissing the Special Leave Petition, the Bench learned that no case for interference with the challenged orders was made out by the Petitioner.
