A Delhi rouse avenue court on Friday granted Congress leader Rahul Gandhi a no-objection certificate (NOC) for issuance of an “ordinary passport” to him after he surrendered his diplomatic passport upon his disqualification as a Member of Parliament. 

The no objection certificate has been granted for three years to the Congress leader, instead of 10 years. The judge informed Gandhi’s lawyer, “I’m partly allowing your application. Not for 10 years but three years.” He moved to the court after surrendering his passport after the disqualification as an MP.

Gandhi is an accused in the National Herald case, in which the former BJP MP Subramanian Swamy is the compliant. Notably, Gandhi was disqualified as the member of Lok Sabha after his conviction in a defamation case.

On the other hand, the court ordered Swamy to submit his response to Gandhi’s plea by Friday. Previously, Additional Chief Metropolitan Magistrate (ACMM) Vaibhav Mehta said that the freedom to travel is a fundamental right and that courts had not imposed any restrictions on the Congress leader’s freedom to move around and travel on several occasions without requesting permission.

The ACMM added that the court had not imposed any travel limitations on Gandhi when it granted him bail in December 2015 and had rejected Swamy’s request at the time for the imposition of the restrictions.
