NEET-UG retest must be on concrete evidence that entire exam was affected: SC

The Supreme Court has posted the hearing pleas for July 22 in the alleging paper leak and malpractice in NEET-UG 2024 exams. Apart from this, the court has also directed the NTA to publish on its website the marks obtained by the students in the NEET-UG examination and the identity of students to be masked.

The Supreme Court of India on Thursday stated that a NEET-UG retest must be justified with concrete evidence showing that the sanctity of the entire exam was compromised. The court emphasized that mere allegations or isolated incidents of malpractice would not be sufficient grounds for ordering a retest. 

While hearing the petitions in the NEET-UG retest, a bench comprising the Chief Justice of India, DY Chandrachud and Justices BJ Pardiwala and Manoj Misra, said that the integrity and credibility of the examination process must be significantly affected to warrant such an action. The bench emphasized on ‘social ramifications’ on the society.

People were doing it for money: DY Chandrachud

CJI DY Chandrachud during the hearing observed that the idea of somebody doing this is not to make a national charade about NEET exam. People were doing it for money. He said, “So, it was not to bring disrepute to the exam and somebody was doing it to make money which is evident now.”

To justify the cancellation of the medical entrance tests, CJI further ordered the petitioners to demonstrate that the paper leak in the NEET-UG exam was systematic and had an impact on the entire examination process.

CJI Chandrachud went hard on the petitioner saying that there is no evidence that the cheating took place at Godhra. It cannot say that it was part of widespread malpractice. “It appears that wrongdoing has only happened in Hazaribagh... then after this, we are only left with statistics that 61 students got 720/720… Can we cancel the entire examination on that sole basis?” he added.

Now, the Supreme Court has posted the hearing pleas for July 22 in alleging paper leak and malpractice in NEET-UG 2024 exams.

Apart from this, the court has also directed the NTA to publish on its website the marks obtained by the students in the NEET-UG examination and the identity of students to be masked. The result should be declared separately city and centre-wise.

This decision underscores the importance of maintaining rigorous standards in the administration of national entrance examinations and ensuring that any retests are based on substantial and credible evidence of widespread issues.
