New Delhi: Thirteen years after the death of renowned farmer leader Chaudhary Mahendra Singh Tikait, the Kairana Court has issued an arrest notice related to an old case. This decision sparked confusion and controversy when the police from Bhurakla Police Station in Muzaffarnagar arrived at the Tikait family home in Sisouli to enforce the arrest. Chaudhary Mahendra Singh Tikait, a prominent figure in the farmers' struggle, passed away in 2011, yet legal proceedings have continued in his name.
The arrest notice stems from an unresolved case involving a roadblock in Kandhla, Shamli district, where Mahendra Singh Tikait and several others were accused. The Kairana Court issued a non-bailable warrant due to the failure to submit a death certificate for Tikait, leading to this unusual legal action. The oversight raises significant concerns about judicial procedures, especially in cases involving deceased individuals.
Chaudhary Mahendra Singh Tikait’s grandson, Charan Singh Tikait, has expressed deep concern over this legal mishap. He criticized the administration and judiciary for not verifying the details before issuing such notices. Charan Singh Tikait highlighted the immense difficulty and mental stress such errors cause to the families of prominent individuals. He pointed out that Mahendra Singh Tikait, who passed away on May 15, 2011, has been honored and remembered for his advocacy for poor farmers across India. He questioned how such a mistake could occur and stressed that Bhurakla Police Station should have been aware of Tikait’s death and halted the notice.
The incident has sparked a debate about the effectiveness of the legal system in handling cases involving deceased individuals. The Tikait family is calling for a review and correction of the judicial errors that led to this posthumous arrest notice. The situation highlights the need for improved processes to ensure that such errors do not recur and that justice is served appropriately.
