Kunal Kamra moves Bombay High Court to quash FIR over 'Gaddar' comment

Maharashtra: Stand-up comedian Kunal Kamra has come to the Bombay High Court challenging the FIR registered against him and has requested for quashing of the FIR. Kunal Kamra has asked for quashing of the FIR against him in terms of Articles 19 and 21 of the Indian Constitution on the premise of fundamental right to freedom of speech and right to life. Indeed, Kamra has recently posted a political joke in which it was alleged that he had insulted Maharashtra Deputy CM Eknath Shinde.

The case has been scheduled to be heard on April 21

In this connection, an FIR was lodged against him. Kunal Kamra has moved a petition in the Bombay High Court against the FIR lodged by Mumbai Police against him. Kunal Kamra has applied for quashing of the FIR against him on the basis of Articles 19 and 21 of the Indian Constitution in respect of fundamental right to freedom of speech and right to life. The case has been scheduled to be heard on April 21 before a bench of Justices SV Kotwal and SM Modak of the Bombay High Court.

Mumbai Police issued notices three times

Since an FIR was lodged against Kunal Kamra, the Mumbai Police had issued a notice for questioning him three times, but Kamra failed to appear for questioning three times. On a complaint lodged by Shiv Sena MLA Murji Patel, the MIDC police station had on March 24 registered a zero FIR against Kamra for offences under sections 353(1)(b) and 353(2) (statements conducing to public mischief) of the Indian Penal Code (BNS) and 356(2) (defamation).

Madras High Court gives relief

The MIDC police subsequently passed on the zero FIR to Khar police. Madras High Court grants relief Last month, the Madras High Court had issued Kamra interim anticipatory bail until April 7 regarding an FIR filed in Mumbai on his alleged comment against Deputy Chief Minister Eknath Shinde. Kamra had gone to the Madras High Court on the basis that he was a permanent resident of Tamil Nadu district and would face immediate arrest and physical harm if he goes to Maharashtra. On this ground, Kamra was given interim bail Kunal Kamra recently shared a clip from his show on social media platform X on March 23. Following this, the controversy began. Following this video, the fans of Eknath Shinde became enraged and damaged the studio where the show was conducted. An FIR was also filed against Kamra.
