Jammu and Kashmir LG gets more powers as MHA amends Reorganization Act

After amendments, the LG of Jammu and Kashmir gained increased executive powers, similar to other Union Territories in India. This includes more authority over administrative and legislative matters previously under the purview of the state government.

In one of the significant moves, the Ministry of Home Affairs has made amendments to the Jammu and Kashmir Reorganization Act have expanded the powers of the Lieutenant Governor (LG), enhancing their authority in the region. The amendments have been made to the Jammu and Kashmir Reorganizational Act, 2019.

The approval for the amendments has been given by President Draupadi Murmu. According to the rule exercising the powers conferred by section 55 of the Jammu and Kashmir Reorganizational Act, 2019 enhances some powers of the Lieutenant Governor of the erstwhile state.

It is important to note that these changes are significant as they modify the administrative structure and governance framework in Jammu and Kashmir, potentially affecting how policies are implemented. Decisions are made within the union territory.

According to the experts, these amendments are aimed to streamline governance and possibly strengthen central control over the region's affairs.

The improved authorities shall come into force from July 12. Regarding the enhancement of powers for the Lieutenant Governor (LG) of the Union Territory of Jammu and Kashmir, the amendments made by the Ministry of Home Affairs (MHA) under this act include:

Incresed Executive Powers

After amendments, the LG of Jammu and Kashmir gained increased executive powers, similar to other Union Territories in India. This includes more authority over administrative and legislative matters previously under the purview of the state government.

Apart from this, he will also have more authority over key appointments, such as the Chief Secretary and the Director General of Police, which were previously made by the state government. The gained administrative control over the Union Territory also includes control over the police and public order, which were earlier the responsibility of the state government.

Meanwhile, it should be mentioned that the principal rules were published in the Gazette of India dated August 27, 2020, and then amended on February 28, 2024.

It is also important to note that this has come before the Jammu and Kashmir Assembly polls that are scheduled after the conclusion of the Amarnath Yatra on August 19.
