Income Tax department slaps Rs 1700 crore notice to Congress

The Delhi High Court dismissed the Congress party's plea, challenging Income Tax Department's order opening of reassessment proceedings against it for 2017-18, 2018-19, 2019-20, and 2020-21.

The troubles for Indian National Congress do not seem ending as the Income Tax Department has issued demand notice of about Rs 1700 crore to the party, just few days ahead of Lok Sabha Elections 2024. 

According to the sources, the fresh demand notice has been given for assessment years 2017-18 to 2020-21 which also includes penalty and interest. The Congress is already facing crunch of funds since after Income Tax authorities imposed the penalty of Rs 210 crore. 

Rejection of plea

Earlier this week, the Delhi High Court dismissed the party's plea, challenging Income Tax Department's order opening of reassessment proceedings against it for 2017-18, 2018-19, 2019-20, and 2020-21.

The demand notice was sent without assessment orders, according to Congress MP and attorney Vivek Tankha, who filed the matter in the Delhi High Court seeking a stay on the reassessment processes.

On Thursday, the Division Bench of Justices Yashwant Verma and Purushaindra Kumar Kaurav dismissed four pleas from the Congress in a manner consistent with its previous ruling, which dismissed similar pleas from the same political party with regard to the three-year reassessment proceedings.

Before that the Delhi High Court upheld the Income Tax Appellate Tribunal (ITAT) order refusing to stay on the Income Tax notice for recovery of more than Rs 105 crore as outstanding tax against the Congress. The court also granted liberty to the petitioner to move the appellate tribunal afresh with the grievance.

The Congress recently approached the ITAT to sought the stay against the proceedings on recovery and freezing the bank accounts.

While back firing at BJP, Congress leader Ajay Maken during a press conference said, "We have received notices from the time of Sitaram Kesari, from 1993-94... We have been demanded to pay Rs 53 crores from the time of Sitaram Kesari. A total of Rs 1823 crores has been made by the IT department from Congress."

He questioned the income tax department why same parameters are not being used to analyze the violations by BJP. BJP has a penalty of Rs 4600 crore, why I-T is not asking them to pay, said Ajay Makan.
