Excise policy case: Delhi Court issues fresh summons to CM Arvind Kejriwal; Know why

The Enforcement Directorate had approached the court filing second complaint for avoiding five summons. The Delhi Rouse Avenue asks to appear him on March 16.

The Delhi Rouse Avenue Court issued a fresh summons to Delhi CM Arvind Kejriwal asking him to appear physically on March 16. The Enforcement Directorate had approached the court filing second complaint for avoiding five summons issued to him in a money laundering probe related to the alleged Delhi liquor scam. 

CM Kejriwal skipped multiple summons

ED on Wednesday had filed a new complaint in Rouse Avenue Court requesting to prosecute Chief Minister Arvind Kejriwal for not complying with the summons in the investigation of alleged money laundering case related to excise policy. Official sources said that the new complaint pertains to non-compliance of summons numbers 4 to 8 sent to Aam Aadmi Party (AAP) national convenor Kejriwal by the federal probe agency under Section 50 of the Prevention of Money Laundering Act (PMLA).

ED has filed a new complaint under Section 174 of the IPC (disobedience to order of a public servant) along with Section 63 (4) of the PMLA and other sections. This section of PMLA pertains to willful disobedience of any instruction. 

Same action with former Jharkhand CM Hemant Soren

ED had also taken similar action against jailed former Jharkhand Chief Minister Hemant Soren. A Ranchi court had prima facie held the Jharkhand Mukti Morcha (JMM) leader guilty of disobeying the notice issued by the agency and asked him to appear on April 3.

ED filed petition in Delhi Rouse Avenue Court

Even before this, ED had filed a petition in Rouse Avenue Court demanding prosecution against CM Kejriwal for not appearing on the first three summons issued to him. The thing to note here is that on the first complaint of ED, Rouse Avenue Court had summoned CM Kejriwal on March 16. On this second complaint also, the court has called CM Kejriwal for appearance on the same day.

On the other hand, CM Kejriwal had termed all these eight summons of ED as 'illegal' and had informed the central agency that they can be interrogated through video conference after March 12. 
So far, ED has arrested AAP leaders Manish Sisodia and Sanjay Singh, party communication in-charge Vijay Nair and some liquor traders in this case.
