The Supreme Court of India has postponed the hearing on a series of petitions challenging the validity of the Places of Worship (Special Provisions) Act, 1991, to the first week of April. This decision comes amid concerns regarding the excessive filing of intervention applications in the case, prompting Chief Justice Sanjiv Khanna to emphasize the need for limits on such submissions.
On February 17, 2025, a bench comprising Chief Justice Sanjiv Khanna and Justice Sanjay Kumar decided to defer the hearing on the batch of pleas related to the Places of Worship Act. The Act mandates that the religious character of places of worship be maintained as it existed on August 15, 1947. The court expressed its displeasure over the numerous fresh pleas filed in this matter, indicating that it may not be able to address all applications due to their volume.
During the proceedings, Chief Justice Khanna highlighted the issue of excessive interim applications being filed, stating, “There is a limit to which petitions can be filed.” This comment reflects growing frustration within the judiciary regarding the increasing number of interventions that complicate legal proceedings. The CJI's remarks underscore a need for judicial efficiency and clarity amidst ongoing legal disputes.
The Places of Worship Act has been a contentious topic, particularly concerning its provisions that bar changes to the religious status of places of worship. The Act excludes the Ram Janmabhoomi-Babri Masjid dispute from its purview. Various Hindu groups have sought to challenge this law, arguing that it restricts their rights to reclaim places they believe were originally temples.
