Divorce in Islam is known as a way to terminate a marriage relationship. Divorce has a number of different types, and each has its own procedure and consequences. The Bombay High Court recently gave a landmark judgment, making it clear that Talaq-e-Ahsan is not an offense under the Muslim Women's Act, as compared to triple talaq.
There are four primary types of divorce in Islam:
1. Talaq-e-Biddat (Triple Talaq): The Triple Talaq is tantamount to a crime in Indian law. The husband says the word "talaq" three times together, and it is an immediate divorce.
2. Talaq-e-Hasan: This type of divorce takes three months, where the husband pronounces divorce in three consecutive months, making an attempt towards reconciliation in between.
3. Talaq-e-Ahsan: This is also a three-month process, where the husband utters divorce once and the couple lives apart for three months. If they get back together within these three months, the divorce is nullified.
4. Khula: This is a divorce at the wife's initiative, where she requests that the marriage be dissolved. It involves the agreement of the husband and usually entails the wife handing over her dowry or gifts.
