In a significant ruling, a civil court has directed the Dehradun Municipal Corporation (DMC) to reconstruct three unlawfully demolished houses in the Niranjanpur area. Additional civil judge Indu Sharma has further instructed the DMC to provide Rs. 1,000 per day as compensation to each affected family for homelessness, amounting to a total of Rs. 13 lakh per family.

Reconstruction Deadline

According to report by Firstpost, the municipal corporation has been given a strict one-month deadline to complete the reconstruction of the homes belonging to Sarita, Guddi, and Shanti Devi. These houses were reportedly demolished amidst a dispute during the Covid pandemic.

Legal Victory

The victims' advocate, Jitendra Kumar, revealed that the court issued the verdict on April 12, with the ruling made public on Saturday. Kumar emphasized that the judge recognized the municipal corporation's violation of regulations, particularly amidst an ongoing legal dispute, leading to the entitlement of compensation for the affected families.

Background of the Dispute

The affected individuals, originally allotted plots in 1995 due to their 'backward and Scheduled Caste status,' had constructed their homes on the land, with their names registered in government records. However, in 2003, the DMC asserted ownership of the land and threatened demolition, prompting the victims to secure a stay order from the court.

Defiance of Legal Stay Order

Despite the unresolved case, the corporation proceeded with the demolition, disregarding the legal stay order. This defiance prompted the victims to demand reconstruction and compensation, leading to the recent court ruling in their favour.

The court's decision to mandate the reconstruction of the unlawfully demolished houses and offer compensation underscores the significance of upholding legal rights and ensuring accountability from civic authorities. It serves as a beacon of hope for marginalized communities seeking justice in the face of unjust actions.
