In a major development that brings relief to Umar Ansari, son of the late gangster turned politician Mukhtar Ansari, the Supreme Court has granted anticipatory bail to him in a case related to the alleged violation of the Model Code of Conduct. During the court proceedings, a bench comprising Justices Hrishikesh Roy and PK Mishra deliberated on the matter. The bench issued the order, directing Umar Ansari to appear before the trial court regarding the case. This decision will enable his release on bail, providing a temporary reprieve from legal proceedings.
Senior advocate Garima Prasad, representing the Uttar Pradesh government, highlighted the alleged involvement of Ansari in instigating people at a public gathering. However, senior advocate Kapil Sibal, representing Ansari, countered the claim, asserting that Ansari had appeared in the lower court and even deposited surety bonds to demonstrate his cooperation with the legal process.
After carefully considering the arguments presented by both sides, the bench expressed its willingness to grant relief to Ansari. Consequently, anticipatory bail was granted, with the condition that he must appear before the trial court and furnish a surety bond as per legal requirements.
This decision comes after the Supreme Court provided protection from arrest to Umar Ansari in the same case on January 25. However, the road to obtaining bail was not without obstacles, as the Allahabad High Court had previously rejected his anticipatory bail plea on December 19, citing prima facie evidence of criminal activity against him.
The case originated from an FIR filed on March 4, 2022, against Abbas Ansari (SBSP candidate from Mau Sadar seat and Omar's elder brother), Umar Ansari, and 150 others at Kotwali police station in Mau district. The allegation stemmed from remarks made by Omar Ansari during a public meeting at Paharpura Maidan on March 3, 2022, which allegedly violated the Model Code of Conduct.
