Assam CID Summons Rahul Gandhi and Congress Leaders for Nyay Yatra Inquiry

Assam CID stated in its summons that there are good reasons to examine Rahul Gandhi and other Congress officials in order to gather information for its probe.

11 Congress leaders, including Rahul Gandhi, have received summonses from the Assam Police's Criminal Investigation Department (CID) to appear before them on February 23 in response to a formal complaint (FIR) filed against them regarding alleged altercations that occurred during the party's Bharat Jodo Nyay Yatra in the state earlier this year.

On what grounds, though? 

According to the officials, the summonses were sent out on Monday in accordance with Section 41A(3) of the Code of Criminal Procedure (CrPC).

In addition to Rahul Gandhi, the CID has also questioned Assam Congress President Bhupen Kumar Bora, member of parliament Gaurav Gogoi, leader of the opposition in the Assam Legislative Assembly, Debabrata Saikia, and general secretaries of the Congress party, KC Venugopal and Jitendra Singh.Furthermore, summonses were also sent to BV Srinivas, national president of the Youth Congress, and Kanhaiya Kumar, in-charge of the National Students Union of India (NSUI).

The official statement 

"During the investigation of FIR/Case No. 55/2024 dated January 23, 2024, under Section 120B/142/147/283/253/332/333/188/427 of the Prevention of Damage to Public Property Act 1984, registered at Police Station Basistha, it is revealed that there are reasonable grounds to question you to ascertain facts and circumstances for you, in relation to the present investigation," the CID stated in its order. This was done in exercise of the powers conferred under sub-section (1) of Section 41A of the CrPC.

Further, Kaikhoseh Simte, Inspector of Police, CID, Guwahati, wrote: "You are directed to circumstances from you, in relation to the present investigation." Therefore, you are instructed to come before me on February 23, 2024, at 11:30 a.m. at the CID police station in Ulubari, Guwahati.

Congress Responds! 

In response, the Assam Congress declared that they would follow instructions and appear before the CID. They countered that since none of the leaders listed in the summons had engaged in any kind of damage, this was not necessary.
"They are requesting an appeal from us after they have filed complaints at many police stations around the state. Additionally, they established a Special Investigation Team (SIT), and CID has already called us. Debabrata Saikia stated, "They might combine all the cases into one and call us for questioning.

This is an attempt to intimidate the opposition, he claimed. "Police gathered all the charges against AIUDF president Badaruddin Ajmal for his communal statements in one location, yet they are still phoning us around to try to make us feel bad. This demonstrates their goals, Saikia continued. 

What conspired in Assam? 

On January 18, this year, Rahul Gandhi's Bharat Jodo Nyay Yatra reached Assam; however, they were told not to go to certain places, including Guwahati.Assam chief minister Himanta Biswa Sarma asserted that the Congress representatives were attempting to incite communal tensions in the state, while the Congress alleged that their Yatra was assaulted in several regions by BJP supporters. Sarma requested on January 23 that the Assam police file complaints against Rahul Gandhi and other Congress leaders.

Subsequently, the police filed complaints under several sections of the Indian Penal Code (IPC). Samra added that following this year's general election, the police will detain the leaders of the Congress party who are being implicated.
