The Supreme Court on Monday gave verdict in the Bilkis Bano case, revoking the release of 11 convicts in the brutal gang rape and murder case. AIMIM president Asaduddin Owaisi welcoming the SCs decision said that Bilkis Bano fought her battle on her own to get justice.AIMIM chief Asaduddin Owaisi, along with many others, targeted the BJP-led government in the state in facilitating the release of the convicts. Owaisi pointed out, We have to remember that it was the BJP who helped in their release and garlanded them. The Supreme Court today said that the state of Gujarat acted in complicity with the convicts. The BJP government was helping rapists in Gujarat. Within two weeks, it asked all 11 convicts to surrender before jail officials.The Apex Court held Gujarat government incompetent The bench held that the Gujarat government was incompetent to pass the remission orders but the Maharashtra government. It also said that the appropriate government to decide the remission was the state within its borders and the accused are sentenced, not where they committed crime or the accused are imprisoned.The apex court held that the judgement of May 13, 2022, under which another bench of the top court had directed the Gujarat government to consider remission of convicts as per the 1992 policy. This was obtained by playing fraud on the court and by suppressing material facts.The Gujarat government seized the powers of the Maharashtra government acting in forwarding the judgement dated May 13, 2022. The bench stated it as nullity.
