Some of Mumbai’s most prominent individuals like Tendulkar and Bachchan’s who reside in prime properties near the sea have benefited from the 2019 dilution of the once-stringent Coastal Regulation Zone (CRZ), which was restricted building activity near the coast.

The Maharashtral Coastal Zone Management Authority (MCZMA) recently approved Tendulkar and Bachchan’s proposals seeking to expand bungalow plots with additional floors. The 2019 CRZ notice is under challenge by the Public Green Council.

Cricket legend Sachin Tendulkar home at Perry Go Across Street near Bandra’s Carter Street coastline is one of them. Tendulkar and his wife Anjali proposed adding or changing their bungalow.

The Tendulkar—Sachin and Anjali—asked permission to add more space to their bungalow near the Carter Road seafront after the new CRZ rules that allow for more construction rights were announced in 2019. Since it falls under CRZ II, the bungalow was given the go-ahead to build in 2011 having  floor space index (FSI) of just 1. It currently consists of a ground floor, three floors, and a part of a fourth floor for residential use, an upper basement for service and storage, and a lower basement for parking cars.

The ratio of buildable area to plot size is known as FSI. By paying the authorities a premium to utilize the additional FSI and transfer of development rights (TDR), the Tendulkars intend to construct the entire fourth and fifth floors of the existing building. Expansion change in the current lodge with part fourth and the full fifth floor is allowed subject to existing FSI standards and different guidelines as of date of distribution of CRZ Notice, 2019,”

Actor Jaya Bachchan, through Rajesh Yadav, submitted a second proposal for additional construction, this time for alterations and additions to a building in the Kapol society known as Juhu Vile Parle. In 1984, Plot No. B2 (Jalsa), which had a basement, ground floor, and two upper floors, was approved. The new plan calls for the construction of the entire second floor instead of just a portion of it and an additional foundation for residential use.

Manufacturer Kailash Agarwal created the third proposition for his Worli Seaface extravagance private structure called Nishika Patios. It stated, “The plans are proposed by using the plot potential plus 0.5 government FSI by paying the premium and claiming staircase, lift, and lift of lobby area free of FSI as per DCPR 2034.” The authority approved the proposal subject to a list of BMC and developer compliances. There are currently two podiums, a two-level basement, and 17 floors in the tower.

With the proposal of residential flats, the developer has now sought permission to expand the building’s rear side horizontally and vertically. There will be 18 upper floors in the new building.

“The draftsman has proposed to guarantee 0.84 FSI extra FSI on the installment of the premium… The plot which falls in CRZ II and is arranged on the lafidward side of the current street,” it said. The i BMC has already approved the new building plans.

Using the new regulations, Roopam, the Worli Seaface property of Cyril Shroff, managing partner of the law firm Cyril Amarchand Mangaldas, will also be expanded. Shroff wants to add another floor to the ground-plus-three-story building that is already there. Additionally, a second building at the building’s rear is included in the proposal.

In the past, the base FSI was limited to just 1. In any case, it changes from 2.2 to 4 or more 35% fungible FSI, contingent upon the street width and plan.”

A Vanashakti environmental activist, D Stalin, stated, “On the one hand, you have slums where water enters during high tide. On the other hand, the wealthy want to leave more of their mark on the coastline. He asserts that the urgent requirement is to comply with the CRZ notification’s spirit and purpose rather than taking advantage of its flaws to increase the burden on the coastline.

“We must move landward to provide the sea with the space it requires.” Although Mumbai builders have sufficient influence to amend any law that hinders their commercial interests, CRZ norms are intended to regulate construction on the coast.”
