The top court on Friday refused to grant additional time to low-cost air carrier SpiceJet to clear its payments to Kalanithi Maran following its order from February.The court noted that SpiceJet was pursuing a luxury litigation and added that it will not grant the extension to SpiceJet as commercial morale must be upheld.As a result of this, SpiceJet will have to pay over ₹380 crore to Maran.During the hearing today, senior advocate Mukul Rohatgi who was representing SpiceJet requested the court to grant them the extension and said that they are ready to pay ₹10 crore immediately to show their bona fides.On the other hand, senior advocate Maninder Singh who was appearing for Maran argued that the air carrier has not paid them any amount according to SCs last order and requested the court not to grant them an addition extension.Earlier, in February 2023, Supreme Court in its order disposed of the case directing SpiceJets ₹270 crore bank guarantee to be encashed and asking the airline to pay ₹75 crore towards interest within three months.Along with this, the apex court earlier cleared that in the event of failure of SpiceJet to pay, the entire award executable would become in favour of Kal Airways and Kalanithi Maran.It is to be noted here, that in May, Maran moved Delhi High Court stating that SpiceJet has not made up with the order of the top court. The Delhi High Court thus directed SpiceJet to pay the entire amount of interest to Maran, which is ₹380 crore.
