Byju’s edtech firm, has been making the provident fund contribution with a lag of almost three to four months. As per sources, company has just made the contribution for December only in June.

According to the information, the multiple independent PF consultants have seen the data which is obtained by the EPFO, which confirms that there is a delay in payments from the last few months as complained by the employees.

The data also shows that the passbooks of the employees were not showing contributions since last November, however, the salary slips showed the contribution towards PF. The data shared by the sources, also indicates that only 10,000 to 13,000 employees have received the PF contribution for January, February and March. But, a large group of workers are still to receive PF payments for April and June.

However, Byju’s has not responded to this yet.

According to a ruling of the Supreme Court in February 2022, an employer is required to cover damages if an employee’s PF contribution is delayed from his side. Under the PF Act, companies are required to make PF contributions before the 15th of next month and if there is a delay in payments, employees can file a complaint with the EPFO against the employer.

If an employee registers a complaint against the employer, an enquiry gets initiated by the EPFO against the employer. The organisation can also order to recover the amount of late deposit, apart from this, a police complaint can also get filed against the employer. However, before proceeding to any legal penal action, the employer is given sufficient time and opportunity to present their point.
